DigiDog Studios reserves the right to change the terms, conditions, and notices at any time, and such modifications shall be effective immediately upon posting of such changes. You are therefore responsible for regularly reviewing these Terms of Use and additional terms or notices posted on the DigiDog Studios website. Your continued access of this website shall be deemed your conclusive acceptance of the modified agreement.

Privacy
Please review our Privacy Policy, which also governs your visit to DigiDog Studios, to understand our practices regarding the use and disclosure of your personal information.

Content
We will NOT under any circumstances, design, redo, create or render our website design and development services to any sites that promote, endorse, duplicate, link to, or deal with the following:

• Sexual or sexually explicit material or contents. Content that is unlawful, harmful, threatening, abusive, harassing, torturous, defamatory, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable. Content that infringes upon any trademark, copyright, patent, trade secret, or other proprietary rights of any party. Hacking, warez, virus transmittal, or computer activities of an illegal nature. "Spamming", pyramid schemes, junk mail or the transferal of unsolicited e-mail or advertising techniques. Content that is harmful to minors in any way.
• Instructional information about illegal activities, promoting physical harm or injury against any group or individual.  This may include, but is not limited to, providing instructions on how to assemble bombs, grenades and other weapons etc.
• Animal cruelty or procedures deemed harmful, unnecessary or unnatural to animals.
• Any activity considered illegal under federal, state and international laws.

We reserve the right to deny service to any site for these or any other unspecified above reason.

Photo Restoration

• We cannot edit pictures that are protected by copyright laws. Illegal reproduction may result in legal action by the photographer. By submitting photographs to us for restoration or correction, you affirm that no copyright is infringed.
• Any requested extra reviews other than what is provided in a standard workflow can increase costs.
• DigiDog Studios is not responsible for any losses, damage, or delays caused by the US Postal Service or other package delivery services.
• DigiDog Studios retain the right to display photo restoration samples that DigiDog Studios created for clients as examples of their work in the portfolio.
• Our time spent for photo restoration and other photo services are non-refundable, therefore when you purchase photo services they are also, NON-REFUNDABLE.

Copyrights and Trademarks
The entire contents of this website, including but not limited to: text, graphics, logos, button icons, flash animations, images are the property of DigiDog Studios and it's clients, are protected by copyright and trademark laws. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute any portion of the website contents without the prior express written consent of DigiDog Studios, LLC.

You may print or download portions of the materials from various areas of this website solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials.

Web Design Project Copyright
Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork provided to DigiDog Studios for inclusion in the project are owned by client, or that client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, indemnify and defend DigiDog Studios from any liability (including legal fees and court costs), including any claim or suit, threatened or actual, arising from the use of such elements furnished by client.

The copyright for all material provided by DigiDog Studios such as design, graphics, programming codes, photographs, text and any artwork will remain the property of DigiDog Studios until such time as payment has been made in full whereupon they will become the property of the client.

DigiDog Studios retain the right to display graphics, websites, photo restoration samples and other web design elements that DigiDog Studios created for clients as examples of their work in the portfolio.

Web Design and Development Billing
Clients will pay a 50% deposit for web development fees before work begins. The remaining 50% will be due upon completion of the project.  Your site will not be launched until all design fees have been paid. 

Web Design and Development Project Cancellation/Rejection
If performance of the work is cancelled or work is rejected by the client, the client shall pay a cancellation/rejection fee as follows:
(i) 25% of the agreed quote if the work is cancelled/rejected before presentation of roughs;
(ii) 35% of the agreed quote if the work is cancelled/rejected at the presentation of rough stage;
(iii) 100% of the agreed quote if the work is cancelled/rejected on the delivery of the final version;

In the event of cancellation or rejection, ownership of all rights granted under this agreement shall revert to DigiDog Studios unless the work is based on the client’s visual or otherwise agreed. 

License and Website Access
DigiDog Studios grants you limited license to access and make personal use of this website and not to download (other than for page caching purposes) or modify it, or any portion of it, except with the express written consent of DigiDog Studios. This website or any portion of this website may not be reproduced, duplicated, adapted, copied, sold, resold, transmitted or otherwise exploited for any commercial purpose without the express written consent of DigiDog Studios.

Linked websites are not under the control of DigiDog Studios and DigiDog Studios is not responsible for the contents of any linked site or any link contained in a linked site. DigiDog Studios provides links to you only as a convenience, and the inclusion of any link does not imply or constitute an endorsement by DigiDog Studios.
